Terms of Use

These Terms of Use govern access to the Evidentity website and managed services, define the operational scope Evidentity provides, and set the commercial and legal boundaries around recommendation-readiness infrastructure.

Overview

These Terms of Use govern access to and use of the Evidentity website and services operated by Evidentity LLC, a Wyoming, USA company. By accessing or using Evidentity, you agree to these Terms of Use and, where applicable, any related order form, service agreement, or commercial document governing a specific service relationship.

If there is any conflict between these Terms of Use and a signed order form or service agreement, the signed commercial document will govern for that specific service relationship.

Use of the website and services

You may use Evidentity only for lawful business purposes and in accordance with these Terms of Use. Use of the website and services must remain consistent with authorized roles, agreed scope, operational instructions, and applicable law.

Accounts and access, if applicable

Access credentials are personal to authorized users and teams and must be protected appropriately. You are responsible for maintaining account security, access discipline, and appropriate control over authorized users within your organisation. You must notify Evidentity promptly of any suspected unauthorized access, misuse, or security incident affecting your account or service environment.

Acceptable use

You may not use Evidentity to:

  • violate law, regulation, or third-party rights;
  • interfere with the integrity, security, or availability of the website or services;
  • attempt unauthorized access, extraction, scraping, reverse engineering, or circumvention of service controls;
  • upload harmful code or use the services for abusive, deceptive, fraudulent, or malicious activity.

Intellectual property

Evidentity retains all rights, title, and interest in its platform, software, methods, service logic, documentation, and related materials. Clients retain rights in their own business data, materials, and content provided to Evidentity. Each party grants the limited rights reasonably necessary for the other party to deliver or receive the relevant services.

Service scope

Evidentity provides recommendation-readiness infrastructure, structured AI-facing surfaces, monitoring, diagnostics, and related managed services as described in applicable plans, service pages, order forms, or service documents.

Our role is to strengthen the client-side infrastructure, signal quality, structural clarity, and trust conditions that support recommendation eligibility and durability. Evidentity does not operate as a universal controller of independent third-party systems and does not guarantee any fixed outcome in external AI assistants, search products, maps, OTA platforms, or other third-party environments.

Third-party systems and dependencies

Recommendation behavior in independent AI assistants, search products, maps, OTA platforms, directories, and other third-party environments may change over time and remains outside any single company's direct operational control.

Evidentity's role is to improve the client-side infrastructure and recommendation conditions that support clearer interpretation, stronger trust, and more durable inclusion across those evolving environments. External platform behavior, model changes, interface changes, and third-party release cycles remain external dependencies.

Fees, subscriptions, and commercial terms

Fees, billing cadence, subscription terms, service quotas, renewal conditions, and any applicable cancellation rules are defined in the relevant commercial documents, order forms, or service-specific terms. Where a separate signed commercial agreement exists, that agreement governs the applicable commercial relationship.

Suspension or termination

Evidentity may suspend or terminate access to the website or services for material breach, unlawful use, security risk, misuse of the service, or persistent non-payment, subject to the applicable contract terms and law.

You may stop using the website or services at any time, subject to any contractual commitments, notice periods, or cancellation terms applicable to an active service relationship.

Disclaimer of external platform control

Evidentity does not own or control independent AI systems, search engines, maps, OTA platforms, directories, or other third-party interfaces through which recommendation behavior may be observed. We do not warrant uninterrupted behavior, stable ranking logic, or unchanged recommendation patterns in those environments.

Our services are designed to improve recommendation-readiness conditions, structural trust, and interpretability on the client side, not to claim ownership over third-party platform outcomes.

Limitation of liability

To keep risk aligned with the value of the services, each party's liability for direct damages arising out of or relating to these Terms of Use will be limited to the fees paid or payable for the relevant service period giving rise to the claim, except where such limitation is not permitted by applicable law.

Nothing in these Terms of Use excludes liability that cannot legally be excluded or limited under applicable law.

Governing law and jurisdiction

These Terms of Use are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Unless otherwise required by applicable law or stated in an applicable signed agreement, disputes will be handled in the courts located in Wyoming, USA.
